Firebird Photo Contest Rules and Regulations

Help celebrate the Firebird’s fifth anniversary at the Bechtler Museum of Modern Art in Charlotte by entering the Firebird Photo Contest for the chance to win $555 or a Firebird prize pack.

Post a creative picture with the Firebird to your social media channels and include #cltfirebird. The winners will be chosen based on creativity and artistic use of the Firebird.

Contest Period: November 3, 2014 (12:00 a.m. ET) - November 30, 2014 (11:59 p.m. ET)

Introduction: Celebrate the 5th Anniversary of the Bechtler’s Firebird by posting a creative picture with the Firebird to your social media channels and include #cltfirebird.

Eligibility: The Firebird Photo Contest is open to individuals who are 18 years of age or older at the time of entry. The contest is only open to individuals who are legal residents of the 48 contiguous United States and the District of Columbia. The following individuals are not eligible: employees of the Charlotte Regional Visitors Authority (and their spouses, parents and children). 

To Enter: Post a creative picture with the Firebird to your social media channels (Facebook, Twitter and/or Instagram) and include #cltfirebird

Conditions of Entry: Entrant warrants and represents that the photo
a. is original and has been legally created;
b. does not infringe the intellectual property, privacy, publicity rights, ownerships or any other legal or moral rights of any third party;
c. any people appearing in the image have given the photographer permission to take their photo and enter the photo in this contest.

Each entrant irrevocably grants the Charlotte Regional Visitors Authority and its promotional agency the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times uses) the photo, on an exclusive basis without compensation or approval. The winner's name and/or statements regarding their participation in the contest may be used in media releases or statements without additional compensation. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Charlotte Regional Visitor Authority's use of any element of the entry.

Entrant agrees to indemnify and hold the Charlotte Regional Visitors Authority and its promotional agency (the "Indemnitees") harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnities due to or arising out of the use of the entrant's entry.

Drawing and Notification: The Contest begins on November 3, 2014 (12:00 a.m. ET) and ends on November 30, 2014 (11:59 p.m. ET) or until such time as the CRVA deems appropriate. The CRVA will conduct a random drawing on or about December 3, 2014, to select one winner of the prize described herein. The winner is to be announced on, or about December 5, 2014. Odds of winning the prize depend on the number of eligible entries received. The potential winner will be notified via the social media channel they used to enter the contest, at the CRVA’s sole discretion. If the potential winner does not respond within forty-eight (48) hours from the first notification attempt then such person will be disqualified and an alternate winner will be selected. All notification requirements, as well as other requirements within these official rules, will be strictly enforced.

Prizes: There will be a total of five winners. The grand prize winner will receive $555 and the four runners up will receive a Bechtler Museum of Modern Art prize pack, which includes a Firebird puzzle, a Firebird notecard, a Firebird magnet, a Firebird T-shirt, a Firebird postcard and a Bechtler tote bag.

Termination/Suspensions/Modifications of Sweepstakes: If for any reason this sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of the CRVA, which corrupt or affect the administration, security, fairness, integrity, fulfillment or proper conduct of the contest, the CRVA reserves the right at its sole discretion to terminate, modify or suspend the contest and to select the winner by conducting a random drawing from those eligible entries received up to the termination/suspension date.

The CRVA may also disqualify or prohibit an entrant from participating in the contest or winning a prize in this or any other promotion conducted, at its sole discretion, if it determines that said entrant has violated the official rules or has threatened or is attempting to undermine the legitimate operation of the contest by cheating, hacking, deception or other unfair playing practices (including the use of automated quick-entry programs), or intending to annoy, abuse, threaten or harass any other entrants.

The CRVA reserves the right to make changes in these rules. Any such changes will become effective upon notice via online posting on this page.

Contest Conditions: By participating, entrants agree to be bound by these official rules and the decisions of CRVA and to waive any right to claim ambiguity in the contest or these official rules. By entering, winners and entrants also agree to release, discharge, indemnify and hold harmless contest entities (CRVA or participating partners) and each of their respective officers, directors, employees, agents and representatives, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind, resulting in whole or in part, directly or indirectly, from a) acceptance, possession, misuse or use of any prize or participation in any contest related activity or participation in this contest, b) any malfunction or other problem with the contest entry sites, c) any error in the collection or retention of entry information, or d) any typographical or other error in the printing, offering or announcement of any prize.
